Withdrawals and warranties

1) Right of withdrawal
If the customer is a "Consumer" as defined in Article 3 of the Consumer Code, he has the right to appeal to the art. 64 of the Consumer Code in accordance with that legislation and therefore he has the right to terminate the Purchase Agreement (the "Withdrawal's Right") for any reason, without explanation and without penalty, in the way set out below.
The withdrawal can refer to all or only some of the goods purchased by the Consumer at dusciana.com. The right of withdrawal is exercised by sending - within 14 (fourteen) working days from the date of receipt of the goods - a registered letter addressed to:

The communication can be anticipated within the same period by sending an email to the address provided in the contacts, that will be confirmed by return mail within 48 (forty-eight) hours.
The notice of withdrawal must specify the intention to withdraw from the purchase and the product or products for which the Customer intends to exercise the right of withdrawal, enclosing a copy of the purchase invoice and the transportation documents (DDT). In this communication the Customer must also confirm that the product or the products are intact and preserved in perfect condition in their original package, complete in all their parts.
Following the proper exercise of the right of withdrawal, dusciana.com will forward to the Client the file number via email. This number must be specified by the Customer upon return of the products.
The product must be returned within thirty (30) calendar days from the date of receipt of their receipt by the Customer to the store Studio Du, Via Cerchio 4/a, 48121 Ravenna (Italy).
The right of withdrawal is subject to the following conditions:
a) The law is applied to each product purchased in its entirety;
b) the purchased products must be returned undamaged and in their original package, complete in all their parts (including packaging manuals and other original documents);
c) the transport costs for the return of the Product shall be at the Customer's expenses;
d) the refund is under the full responsibility of the Customer.

If case the withdrawal has been exercised properly, dusciana.com will refund the Customer the full amount paid, including delivery charges, within thirty (30) calendar days after receipt of notice of withdrawal. The amount will be refunded after the deduction of the expenses for the return of products, which will be at the Customer's expenses.

2) Warranties
a) Legal warranty for the Consumer
I. The Consumer, as defined in art. 3 of the Consumer Code, Legislative Decree September 6, 2005, n. 206, has the right to appeal to the legal guarantee as per the Consumer Code in Articles 128-132.
II. This warranty provides to the Consumer, inter alia, at risk of forfeiture, to denounce to dusciana.com any lack of conformity found in the product purchased by the consumer within two (2) months from the discovery of the lack (section 132 of the Consumer Code).
III. Following this complaint, the Consumer shall be entitled to require repair or replacement of the product, without prejudice to other rights provided by law in favor of the consumer.
IV. The legal warranty is valid for a maximum period of 2 (two) years from delivery of the product. Beyond this period, dusciana.com will not be liable for faults found by the consumer.
V. In case of replacement or repair of the product, the terms of the guarantee given on the product resulting from the repair or replacement, are the same as the original product. Therefore, the total duration of the two-year legal guarantee, however, starts from the delivery of the original product.
VI. To take advantage of the warranty, the Customer must show the tax document (invoice or receipt) stating the effective date and place of purchase.
VII. In any case, for the regulation of the legal guarantee, reference is made to the rules of the Consumer Code referred to in Articles 128 et seq.

b) Legal Warranty for non Consumer Customers
I. The non Consumer Customer, as defined in art. 3 of the Consumer Code, may use the legal warranties provided in the Civil Code. II. This warranty provides, among other things, to the non Consumer Customer, at risk of forfeiture, to denounce to dusciana.com any lack of conformity found in the product purchased within 8 (eight) days of discovery.
III. The Legal warranty above is valid for a maximum period of twelve (12) months from delivery of the Product. After that period dusciana.com will not be liable for faults found by the non Consumer Customer.
IV. To take advantage of the warranty, the Customer must show the tax document (invoice or receipt) stating the effective date and place of purchase.
